Health and social care services use the Philosophy of Careto support vulnerable people by implementing their rights according to the right legislation and codes of practice. The legislation also provides way to protect the service users for harm and abuse. A person-centred approach used by the services ensure individual needs of service users. Although the philosophy of care is used to improve and care for service users yet there is still ethical dilemmas and conflicts that we face. As a care workers in ABC care home we have to do all the required training to always know and do what is expected of us when it comes to protecting service users and use the theories of human development that can help me manage with the considering of social processes to make recommendations for health and social care services to vulnerable people with others professionals. Principles are simply rules or guideline. In this case we are looking at guideline of support. Principles of support are useful to health and social care settings success. We can apply principles of support to ensure that individuals are cared for by promoting Anti-discriminatory practice. The first one is to protecting service users from harm and secondly is to safeguard vulnerable people from abuse. So protection in Health and social care is to safeguard from harm or abuse. Harm is damage or injury caused by people or event. Abuse is a violation of individuals human and civil rights. Safeguard from abuse is the multi-displinary work done by care services or other Organisations to minimise and manage risk to Adults that could be exposed to abuse. ABC care home Staff should to know who is behind enforcing the philosophy of care and how it’s applies to protect the entire ABC care home staff and the care home. To Protect ABC care home staff and anyone else that might use the services ABC Carers have to get induction and training when they start work. This is to ensure that ABC Carers have enough knowledge about ABC workplace. This is finding out information and facts for me to settle in ABC care home. This includes codes of practice, rules and regulations that run the care home hence protecting service users and one else that can come to the premises. Training can help Carers to protect service users at ABC care home form harm by learning how to manual handle. This is using my bodily force to lifting, lowering, pushing, pulling or caring service users within the care home. The regulation that covers manual handling is. For this to happen the effective training cycle was created and it has to be fully followed for effective training to be achieved. The cycle involve Identifying training needs, establish training objectives, developing training activity, deliver training activity, check training objectives made and measure improvements. For training to work effectively with in the ABC care home, Trainers have to ensure that they are using every part of the cycle step by step. This will not only benefit ABC care home but it will help focussing on the right service user for the right reason hence this leading to the desired outcome of training. To be able to protect vulnerable people in ABC care home Carers have to make sure that their personal hygiene is up the standards of Health and social care settings. Hygiene can be achieved in appearance, dressing, behaviour and personal cleanliness. Due the fact that caring for vulnerable people in ABC care home involves serving food. Every staff that deals with serving food has to be clean so that they do not contaminate service users food and this can reduce service users from being food poisoned. More to that, ABC care home carer need to know about food hygiene. To protect everyone at ABC care home from harm Carers should follow the Health and safety at work Act (HASWA) 1974 Regulations. This act was created to ensure that health and safety at workplace was less risky of harm and injury. Secondly, ABC Carer should apply the reporting of injuries, diseases and dangerous occurrences to the health and safety Executive or local Authority. (RIDDOR) 1995. Furthermore, Management of Health and Safety at work Regulations (MHSWR) 1999. The regulation needs employers and managers to do risk assessment in work place. The application  of this Regulation can help reduce hazards. (Health and social care Diploma) The Disability Discriminating Act (DDA) 1995. It puts responsibility on employers to make sure that people with disability can get safe access and exit from the workplace. (Health and social care Diploma) Another Regulation that can really be useful in a care home is (COSHH) 2002. This means the control of substances Hazardous to Health. It provides a framework to reduce the risk to Health and safety in association with hazardous substances. (Health and social care Diploma). ABC carer should know a few techniques about first Aid. First Aid is the first help given to sick or injured person until full medical treatment is available. This will enable Carers to help service users in case of emergency. For example if a service user is unconscious and breathing they should be placed in the recovery position and so on. Carers in ABC Care home should use the Whistle Blowing Policy; (www.gov.uk/whistleblowing) If a member of staff in ABC care home is miss treating service users or other Carers its Carers’ job to report the crime to the manager or local council depending how big the problem is. Appling the Medicines Act 1968 would minimise the risk to service users in ABC care home by giving medicine to the right service user, right time, right medication, right dosage and route. (legislation.gov.uk). 1.3 ANALYSE THE BENEFIT OF FOLLOWING A PERSON CENTRED APPROACH WITH THE USERS OF ABC CARE HOME. The person centred approach was developed by Carl Rogers (1902-1987) a Psychologist. This was mainly in relation to the therapist and the client, he named it the client centred approach then later he renamed this theory a person centred approach because he wanted to minimise the individuals’ Autonomy. He developed a person centred approach as a way of counselling and psychotherapy. This approach is applied essentially as a Non Directive. Following a person centred approach in ABC care home would help in developing a service user focused service by ensuring that their needs are fulfilled. For example, Health care workers have to provide assistance to the disabled people by doing things for them that they can’t do themselves. For example, some disabled people can’t bath themselves in this case caretakers have to bath them. Using a person centred approach in ABC care home could help to find out Areas to be improved within the care home. This is by care staff in ABC home ensuring  that every individuals’ need is given the right solution. For example, the right wheel chair for different types of disability. Applying a person centred approach in the ABC home can help users to plan ahead for their lives. Care workers can support users achieve their long term goals. This is making sure that service users are well fed and given medication if they are sick to maintain a good health. Using a person centred approach in ABC care can enable users to have choice and control of their own lifestyles. (metro.gov.uk). For example, service users can decide what type of clothes they want to wear. 1.4 Explain ethical dilemmas and conflict that may arise while providing care, support and protection to users of health and social care services. The Ethical dilemma is ‘a situation in which a different choice has to be made between two or more alternatives, especially ones that are equally undesirable’. (Oxford dictionary 2012). The ethical dilemma that has been faced by ABC workers when caring for Mrs. M is that she has acute pains and painkillers prescribed by the doctors are not working due the fact that she likes drinking whisky that she has failed to cut down and this is affecting the painkillers from working. The conflict in Mrs. M’s situation is that painkillers are needed to be taken to reduce the pain she is having but the whisky Mrs. M likes taking is stopping the painkillers from working. 2.1 Explain the implementation of polices, Legislation, regulations and codes of practice that are relevant to own work in ABC care home. A Cording to the Oxford dictionary (2010) a policy is ‘a course of actions, as of a government, political, or business, intended to influence and determine decisions, actions, and other matters’. Every Child Matters is one of the policies used in ABC care home for children welfare. (education.gov.uk). every child matters policy’s aim is to ensure that children are healthy. ABC care workers should make sure that children have good physical and mental health by giving them food, encouraging children to have enough exercises and giving them medication when they are sick. In ABC home Children are safe under the Every Child Matters policy. (education.gov.uk). The policy’s aim is to protect children from harm and neglect. Caretakers in ABC home should care for the children by giving the love and ensuring that their needs are  fulfilled. For example, washing their clothes. etc. Care staff in ABC should follow the Healthy and Safety at work act 1974 to minimise harm to children. For example, following (RIDDOR 1995) ABC care takers should report injuries, diseases and dangerous occurrences the Healthy and Safety Executives to so that cases can be followed and investigated to prevent future injuries, diseases and so on. Children should make a positive contribution by engaging in community activities and being part of Society. (education.gov.uk). ABC Care staff should ensure that children are not anti-social and not doing any Crimes. The ABC home staff should encourage children to go school so that they don’t end up is gangs. More to that, Quality protects is another policy that was created by the Department of Health in 1998. (www.rip.org.uk) Quality protects’ aim is to support Local Authorities in transforming the way they manage and deliver Children’s Social services. One of the Quality Protects’ aims in ABC care home is to make sure that Children get a bond to ABC carers enabling safe and effective care for the period of Childhood. For example, there should be a father and son relationship between a Male carer and a boy service user. Secondly, ABC carers must protect Children from emotional, physical and sexual abuse and neglect. ABC Carers should not verbally abuse Children or beat then and ABC carers should do (CRB) checks before they can be employed by ABC care home so that children can be in good hands. Etc. Legislation. The rehabilitation of offenders Act 1974. (legislation.gov.uk). The Act would help service users in ABC care home who have committed crimes to be rehabilitated by enabling criminal convictions with some exceptions to be spent or ignored after a rehabilitation period. For example, crimes committed by mentally sick service users could be dealt with differently. Human Rights Act 1998. (Elizabeth et al. 2010). The Act protects rights given under the European convention on human rights. This Act points out that everyone has a right to live. In the ABC care home under the Human rights Act 1998 (equality humanrights.com) service users should be given a chance to live their lives the way they want and their needs should be fulfilled. Under this Act the right to live means giving service users food, medication and shelter. etc. The Human right Act 1998 protects ABC service users from slavery and forced labour. No service users should be treated  like a slave, ABC carers should not force use rs to do unpaid work around the ABC care home. ABC carers should not discriminate against service users under Human rights Act 1998. Carers should treat every service user the same regardless of where they are coming from. Carers should tolerate and respect Users cultures and religions. No service users shall be punished without law. (Equality humanright.com) ABC care workers should not beat or give any other punishments to service users without court proceedings. Codes of practice (Skills for care). According to skills for care website Codes of practise is â€Å"a list of statements that describes the standards of professional conduct and practice required of social care workers as they go about their daily work†. The code of practice help to protect service users in ABC care home (Skills for care) by protecting their rights and promoting the interest of service users and Carers. ABC carers can do this by treating everyone as an individual, respecting their cultural beliefs and religions, supporting and maintaining dignity and privacy of users. 2.2 Explain how Local policies and procedures can be developed in accordance with national and policy requirements. Local policies are principles of action developed by individual care homes to help safeguard service users from abuse. These principles are developed according to the service users the care home is caring for. For example some children’s care home principles differ from the elderly ones. Policies and procedures when developed they give employers and employees guidelines for fair and legal treatment to every service user in an organisation or care home. Policies create rules of how to run care homes and policies give ways how policies could be implemented within the care home. (www.ehow.co.uk). National policies are principles of action proposed by the government to help safeguard service users in statutory, private and voluntary organisations all around the country. ABC care home would implement the protecting patients from avoidable harm policy. (www.gov.uk/government) by using the five domains obtained from the three part definition of Quality First which states that; Quality care consist of: effectiveness, patient experience and safety. The five domains from the definition are: Preventing people from dying prematurely, ABC carers can prevent people dying prematurely by doing risk assessment, this can help find hazards within the ABC care home that could be life threatening. For example faulty electric switches, sockets and cables could be found by risk  assessing and fixed to ensure that the ABC care home is safe for service users. The second domain is enhancing quality of life for people with long term conditions (www.gov.uk/government). In ABC care home employers can help improve quality of lives of service users with long term conditions by giving them healthy food and encourage them to do exercises so that they can stay fit. Thirdly, help people to recover from episodes of ill health (www.gov.uk/government). With the ABC carers can help service users to recover from ill health by giving patients their medicine on time and by ensuring that doses are finished in the advised time. etc. Treating service users with respect, dignity and compassion policy. (www.gov.uk/government). ABC carers should treat service user with respect, this is by knocking on service users doors to get permission from them before cares can enter. ABC carers should treat service users with dignity and compassion. ABC carers should ensure that service users are not abused and should enable service users to maintain the highest level of independence, choice and control. For example, ABC carers should ask services users what type of food they want to eat by offering users food options. â€Å"Improving care for people with dementia policy†. This policy is implemented in ABC care home by increasing diagnosis rate for people with dementia because there is a low diagnosis for people with dementia in England as whole. For example invest more money in ABC care home to improve the project by buying better toolkit to ensure that ABC employers and employees provide a better service. 2.3 The Care Standard Act 2000 was put in place by the government on 20th July 2000 and came into effect April 2002. The Act was made to help reforming the regulatory system for care services in England and wales. These services include: residential car e homes, children homes, nursing homes, domiciliary care agencies, fostering and so on. The Care Standards Act 2000 aims were to extend the regulation of social Care from two white papers published by the Government in 1998 and 1999 entitled â€Å"Modernising Social Services and Building for the future†. (www.scie.org.uk) The Act established a new independent regulatory body for Social Care, private and voluntary health care services in England known as the National Care Standards Commission (www.scie.org.uk). This was to ensure that improvements in care through the Act’s triple functions of inspections, regulation and reviewing all Social Services. â€Å"The Act established the General Social Care Council† (GSCC). (www.scie.org.uk)To  regulate the quality and standards of Staff working in Social Care but was replace by the Health Professions Council (HPC) from August 2012. Another Act that helped in Social Care settings is the Safeguarding Vulnerable Group Act 2006. The Act is an important part of a bigger programme of work. It spreads across Gov ernment departments and it is created to solve the failures found by the 2004 Bichard inquiry from the Soham murders. Recommendation 19 of the Bichard inquiry report states that; ‘new arrangements should be introduced requiring those who wish to work with children, or vulnerable Adults to be registered. The register would confirm that there is no reason why an individual should not work with these clients’. (Safeguarding Vulnerable group Act 2006 fact sheet). The Act formed a body called the Independent Barring Board (â€Å"IBB†). The IBB establishes and maintains children’s and Adults’ barred list. The Act points out offences and writes down penalties for not complying with the Act. For example if a door is meant to be kept locked and the Manager opens it he could get fined 5000 pounds or six months imprisonment if Inspectors find out. The No Secrets policy document has guidelines on developing and implementing multi-Agency policies and procedures to protect vulnerable adults at risk of abuse. One of the No secrets principles is to recognise people who are unable to take their own decisions or protect themselves, their belongings or bodily integrity this helps to adults at risk of being abused. No Secrets’ â€Å"getting the message across† states that when it comes to employment people convicted of big offences do not have the protection of the Rehabilitation of offenders Act 1974 this could help stop adults being abused. The policy defines who is at risk, what way and what action to be taken when abuse happens to vulnerable people. Hedonism Essay -- Papers

Webster's dictionary defines hedonism as "the ethical doctrine that pleasure, variously conceived of in terms of happiness of the individual or of society, is the principal good and the proper aim of action" or "the theory that a person always acts is such a way as to seek pleasure and avoid pain." With this definition in mind, and with further examination of John Stuart Mill's theory on hedonism, I am going to argue that hedonism is not an exclusive or distinct way of thinking. In fact, I think that with the exception of possibly a few people, most people are very hedonistically inclined. "Hedonistic utilitarians identify happiness with feeing pleasure and avoiding pain, meaning that the more an individual enjoys pleasure and avoids pain, the happier that individual is" (phil.tamu.edu). Now, is this really a new and profound thought? If you avoid pain, you will lead a happier life? With a few exceptions, I don't know many people who see pain as enjoyment. Most people I know have made it a point to enjoy themselves in so me fasion or another, and that doesn't include the enjoyment of pain. "Mill's overall subject is the right of the indivieual to think and act for himeself of herself. For Mill this does not mean the right to think and act as you please (Castell 360). Eventhough Mill encouraged independent thought and actions, he did not justify running around and doing whatever you liked. According to the Hedonic Society, what they call Enlightened Hedonism ("a naturalistic and humanistic lifestance advocation the ration cultivation of pleasure and happiness for all") can be state... ...ve a relatively balanced life, you would include both physical and intellectual aspects of your life. Whether or not you would be labeled a "Hedonist" would remain to be seen. If you incorporate the greater needs of others into your individual immediate needs, then technically, yes, that would be Hedonism. Data Encryption I. What is Data Encryption? Data encryption describes the transformation of plain text into a different format that is meaningless read by human eye without being decrypted, so called cipher text, in order to prevent any unauthorized party to obtain information from the document. According to the Webster dictionary, â€Å"cryptography is the practice and study of data encryption and decryption - encoding data so that it can only be decoded by specific individuals.† Crypto is derived from the Greek word kruptos, to hide, from kruptein, which means hidden and secret. In the old days, people attempted to withhold certain information as their private possession, and to hide the information from exposures to the public. There were many different methods they used in order to conceal this information, such as substituting part of the information by symbols, numbers or pictures for different reasons to protect their secrets. With the advancement of human intellects and modern computing powers, cryptosystems are invented as systems used to encrypt and decrypt data electronically. By deploying sophisticated mathematical algorithm into the process, it combines the original data with one or more a serial of numbers or strings of characters, as known as â€Å"k eys† privately and solely owned by sender and/or recipient. Cipher text is generated as an end result of this process. The computer aided data encryption is much more accurate, efficient and reliable compared to the ancient methods. Organising & Delegating in the Workplace Essay

1.1 The importance of making effective and efficient use of people’s knowledge skills while planning the team’s work to achieve objectives is explained Organising is the managerial function of arranging people and resources to work towards a goal. In order to achieve objectives in an effective and efficient manner it is important to have a good knowledge of the team’s skills. Issues such as lack of motivation in the team or lack of confidence could mean the objective is failed and at the same time enthusiastic, motivated and given responsibility for their work team, can reach the targets and aims and objectives. Overall meeting the objectives of the company could be at risk and cannot be met if the wrong person is chosen. Organising is about planning for a situation; it’s about working together to achieve one goal. To organise I need to ensure that the people I manage and lead are the making the best use of their skills to do that specific task. In Hull Libraries I have to plan for specific times of the year. I know for example that the school holidays are a busy time in Hull Libraries. It is important for the right me mber of staff to be matched with their own knowledge and skills to the task in hand. An example of a task that is needed specifically in the holidays may be a craft sessions. Now I know that certain members of staff do not excel in art and craft sessions. It would not be fair to put a member of staff that did not feel confident and have the correct skills on this task. It would affect their confidence and their motivation. I instead put a member of staff, for example Karen, as the lead for this task. Karen loves arts and crafts, enjoys working with children and is good at these sessions. This means that the children will enjoy it and the parents will feel that the received a good level of customer service. When holding sessions in the past we have had very positive feedback for these sessions. In Hull Libraries if a member of staff is allocated to the wrong area of work then this may have a direct impact on members of the public. Objectives may not be met on time and/or to the standard which they should be. This will not receive the level of customer service that they deserve or expect which can lead to complaints being raised and an unhappy member of the public. This reflects badly on Hull  Library service which we do not want. This may also effect a member of staffs level of motivation and dedication. When this time of year comes we also have a ‘relief’ list of staff. Should we need more members of staff on the counter to cover activities as mentioned above, we can call these staff in on a relief basis to help with the demand. Covering busy periods at the library is quite easy. As a supervisor am I not always on the rota to be on the counter, I am sometimes planned to be in my office. Should demand increase I can go onto the counter to serve customers as and when needed. 1.2 One technique is used to identify the appropriate activity for a person To identify the appropriate member of staff for the correct activity I have used a skills matrix spread sheet (appendix 1). A skills matrix is a table that displays people’s proficiency with certain skills and knowledge. You can link this to the task in hand. Recently in Hull Libraries we have started to hold appointments for Blue Badge assessments, as well as this we also have a summer programme of activities to hold for children and the day to day running of the library. To plan and allocate the correct work to the correct person I have looked at each member of staff and rated their skills needed for the task between 1 and 10. From the skills matric I can also see training gaps and also areas for mentoring. I can see that Karen would be good at mentoring Julie and Anne for children’s activities as they do not have as higher skills, knowledge and confidence as Karen. I can see that it would not be appropriate to put Jacki or Sue on Blue Badge appointments as they have not yet had the appropriate training. This would not be fair on either the member of staff or the member of the public. The service provided would not be to the higher quality that Hull Libraries wants it to be. For the task in appendix one I can see that it would be good to have Karen running the children’s craft sessions, Julie holding the Blue Badge Appointments, Sue helping members of the public with I.T and Jacki and Anne serving the customers on a regular basis. Anne is also trained with the delivery of Bus passes and Rail Cards so she can issue these should a member of the public attend the library for one. A skills matrix can also be used to identify  training needs. I can see that Jacki and Sue need training for Blue Badges. Should the skills matrix have been for a different subject then I would be again ale to identify training needs for other people. 1.3 How human resource planning can be used to assure output and quality is explained Human resource planning is how companies can determine and analyse the requirement of, and supply of if need be, a workforce in order to achieve the organisation’s goals and objectives. HR planning predicts what will affect the availability and requirement of employees in the future. If a company also has too many staff HR planning for the future is key when it may come to making redundancies in a company. Hr planning also takes into account staff that on annual leave, sickness and maternity. This may result in temporary staff being brought in to support core staff. Hull Libraries do have a list of ‘relief’ casual staff who are able to come in should this situation arise. Part of HR planning is the training of members of staff. Training ensures that the right amount of staff have the correct skills and knowledge to provide the customer with the level of service they expect. For workplaces like factories this is slightly easier to predict as they have output of raw materials. They can predict how many items a certain line can make in an hour and plan staffing around orders and the amount of materials needed. Many factories can use formulas to generate their anticipated work load and work force. Many companies for examples can predict that an order has been placed for 100 items. Each member of staff can produce 10 items a day but they only have two days to turn the order around. This means that they will need 5 members of staff minimum to meet the requirement. This is a small example of what companies can predict. Large companies can predict when orders for 1000’s of items are placed. For Hull Libraries it is slightly harder as we do not have key figures as output. The output for Hull Libraries is customer service to the customer.  What the customer expects and what the customers gets. If Hull Libraries were short staffed and still managed to serve customers they would not receive the same quality and time they expect. Conversely, if Hull Libraries were short staffed and ensured that the customer was taken care of and received the level of customer service they expect then not enough customers will be able to be served. Either way, complaints are likely so HR planning is really important. Recently though with the changes that have been happening we have been able to plan staffing with output figures in mind. We know that each library has approximately 30 Blue Badge appointments each week, each taking one hour. This means we have been able to plan staffing to cover the 30 hours of appointments each week. In a couple of cases this has resulted in staff being moved from other libraries and in the long term plan it is going to result in new staff being recruited. Delegating to achieve workplace objectives 2.1 One example of delegation and one example of empowerment in the workplace is given â€Å"Delegation involves giving a member of your team the responsibility for part of your job and the authority to carry it out, but you retain overall control and accountability.† (Williams, 2006) Delegation is an important management skill. Good delegation saves you time, develops your staff and motivates. Poor delegation will cause frustration, demotivation and failure to achieve the task. Effective delegation is crucial for management and leadership succession. Delegation is giving responsibility ensuring that the member of staff knows what is required of them and the standard that is expected. The overall control is retained by me as a manager. This means that the task will still be supported and also the task will not fall behind time constraints. Some tasks are ideal for delegation but some should never be delegated. Tasks that should never be delegated include confidential matters, disciplinary action, appraisals and  counselling staff. Jobs that can be delegated include jobs which are routine, jobs where an individual member of staff be able to do the task to a better standard than myself and jobs of which are low to medium priority. As a manager I have delegated tas ks to members of staff on many occasions. Each month I have a full team meeting and devise a rota of jobs that can be delegated to staff. These are jobs that are a core part of library duties but are not vital jobs for me as a line manager to complete. Some of the jobs may take time when I can be working on higher priority jobs. One of the jobs which I have delegated in the library is the display work. I have delegated this job to Karen. This includes the general posters in the library and then creating the display work in the library including the children’s library. The reason I have delegated this task is for a number of reasons. The job is not a high priority task so I may have another task which need doing first, Karen is really good at producing display work and Karen has a passion for art and really enjoys producing displays. I am not as skilled and do not have knowledge of art and crafts to produce the displays to the calibre of what Karen can. By delegating this task to Karen she has excelled at the job in hand and it has motivated her in her work. Empowerment is a management practice of sharing informa tion, rewards, and power with employees so that they can take initiative and make decisions to solve problems and improve service and performance. Empowerment is based on the idea that giving employees skills, resources, authority, motivation, as well holding them responsible and accountable for outcomes of their actions, will contribute to their motivation. Each month during a team meeting I ask the staff if they had any ideas that they would like to put forward to improve their skills or to improve the customer’s experience of the library. If the ideas seemed a positive one and one we would be able to go ahead with I would speak to my line manager to have the idea authorised ready for implementation. If the idea was authorised I would then speak to the member of staff who had the idea and let them lead on this. One of the ideas that came from one of these meeting was from Sue, one of my members of staff. She had noticed a rise in people coming to the library to use the computers to search for jobs, create CV’s and general help with setting up e-mails and using computers. An idea she put forward was to start a â €˜work club’ at Greenwood Library. The session would be held on a weekly basis where members  of the public could drop in and have advise on the topics mentioned earlier. The management agreed this was a great idea. I then let Sue take the lead on this project as it was her idea. She really enjoyed taking the lead on it and her motivation increased. 2.2 One barrier to delegation and one mechanism to support delegation is identified Delegation is a very important management technique; it brings benefits to team members and team leaders. At times there can be barriers to delegation from team members and from team leaders. Some of the barriers from a team leader/supervisors point of view may be; I can do it better myself, my members of staff are just not capable enough, it takes too much time to explain what I want to be done, if it goes wrong I’ll still be accountable, delegation reduces my own authority, I’ll be shown up if they do too good a job, my staff prefer that I make the decisions and team members want to avoid responsibility. Some of the barriers that staff may feel is I do not understand what I am needing to do, I do not feel skilled enough to do the task asked of me and it’s not in my job description. The most important mechanism is to support your staff throughout the delegation process. Explaining the task in detail and with time to the member of staff is key. Explaining how important the task is and why the task is necessary. Always reiterating to your member of staff that you are there for them should they need any help is important as they will feel supported. Once the task has been completed give the member of staff praise and recognition for the task in which they have completed. It is them vital to pass credit to the member of staff. The will encourage them for future tasks and will improve motivation. 2.3 One technique that could be used to monitor the outcomes of delegation in the workplace is explained Monitoring tasks when delegation has taken place is vital. By monitoring it means the manager stays in overall control and be able to spot potential problems at an early stage. If this occurs the member of staff can then be guided and makes any changes necessary to get back on track. It is important when work is delegated that from the start objectives, time scales and key points are arranged. This is important so that whilst monitoring the delegation you can benchmark them against agreed targets. There are many ways you can monitor the progress and outcome of delegation. This can be by way of meetings with staff, statistical reports, observing the member of staff and gather information from others to name but a few. One I personally prefer is to have regular 1:1 meetings with the member of staff involved in the task. These can be regular informal discussions with the member of staff where I can ask the member of staff how they feel the task is going and if they need any further advice/support. If they need any further resources to complete the task this can be discussed. We can also look at the objectives and see if they are being met. It also gives me a chance to congratulate and praise the member of staff for completing/working towards completing the task. This gives the member of staff a sense of achievement and will increase motivation. Once the task is completed I will have a final meeting with the member of staff to discuss how the task went and what things we can do different in the future. Should it result in a task that may be ongoing I will carry on the meetings to make sure we are making best use of resources. 2.4 The effectiveness of feedback, recognition and reward techniques in the workplace is reviewed. Feedback and recognition is an imperative part of the delegation process. Its gives the manager a chance to speak to the member of staff involved in the task and helps the member of staff to learn from the experience. This may be for a positive part of the task or possibly a negative part. Feedback encourages staff to develop their skills and knowledge for the future. Giving feedback is also a key part of being a manager. Feedback and  recognition can help a member of staff to feel motivated and part of the team. The will feel more confident in future tasks and can be willing to help other members of the team. Some companies have reward schemes to encourage members of staff. This may be variable pay, bonuses, profit sharing and stock options. A business can choose to reward individual or group contributions or a combination of the two. Group-based reward systems are based on a measurement of team performance, with individual rewards received on the basis of this performance. These systems can encourage individual efforts; they also tend to reward underperforming employees along with average and above-average employees. A reward program which recognises individual achievements in addition to team performance can provide extra incentive for employees. It can increase motivation and improve staffs work rate on a regular basis. All of the techniques above help staff to be more motivated in the workplace and encourages them for future tasks. It is a vital cog in the wheel for a business or company. Without the final part staff may feel demotivated and will not be as willing to tasks further tasks on in the future. Discussing Emotions in Spanish Spanish has at least five common ways of referring to emotions or describing how someone feels or becomes emotionally. These include the use of estar and tener; reflexive verbs used for specific emotions; and two verbs that often mean to become, ponerse and volverse. Using Estar With Emotions For English speakers, the most straightforward way to talk about emotions in Spanish is to use estar, one of the verbs for to be, followed by an adjective of emotion. Mi pap est feliz de ver su paà ­s. (My father is happy to see his country.) Las autoridades estn preocupados por el incremento de casos de sobredosis. (The authorities are worried about the increase in overdose cases.) Al principio pensaba que estaban enfadados conmigo. (At first I thought they were angry with me.) Va a estar emocionada por conocerte. (She is going to be excited to meet you.) Using Tener With Emotions Although estar can be used with some emotions, Spanish speakers often prefer to use tener, the verb for to have in the sense of to possess, with some emotions. In effect, the idiom is that a person has a particular emotion rather than that the person is in a certain emotional state. For example, although you could say est asustada to say that a friend of yours is afraid, it would be more common to say, Tiene miedo, literally She has fear. Here some examples of this use of tener: Mi senador no tiene fe en la ciencia. (My senator distrusts science. Literally, my senator doesnt have faith in science.) Antonio le tenà ­a celos a Katarina cuando eran nià ±os. (Antonio was jealous of Katarina when they were children. Literally, Antonio had jealously toward Katarina when they were children.) Si las cosas son diferentes, tendrà © la ilusià ³n de regresar. (If things are different, I will be thrilled to come back. Literally, if things are different, I will have the thrill of coming back.) Reflexive Verbs for Specific Emotions Some reflexive verbs include in their acquiring of an emotion. Perhaps the most common such verb is enojarse, which typically means to become angry or to get angry: Jennifer se enojà ³ cuando la periodista la llamà ³ por telà ©fono. (Jennifer got angry when the newspaper reporter called her on the telephone.) Enfadarse is preferred over enojarse in some regions: Si pierden los llaves, me enfadarà ©. (If they lose the keys, Ill get angry.) Here are some of the reflexive verbs frequently used for other emotions: aburrirse (to get bored with, to get tired of): El abuelo de la actriz  se aburrià ³ de su libertina nieta y la desheredà ³. (The actress grandfather got tired of his wild granddaughter and disinherited her.) asustarse (to become frightened): Vi a la policà ­a y me asustà ©. (I saw the police and I got scared.) alegrarse (to become happy): Se alegrà ³ mucho de recibir la noticia. (She became very happy upon hearing the news.) enamorarse (to fall in love): (Te enamorars de los chicos salvadoreà ±os. (My decision came about simply because I became annoyed at depending on nicotine.) irritarse (to become irritated):  ¿Se irrita usted con facilidad? (Do you get irritated easily?) calmarse (to become calm): Durante todo el trayecto estaba preocupado, pero me calmà ³ cuando estbamos aterrizando. (During th e whole flight I was worried, but I calmed down when we were landing.) entusiasmarse (to get excited): Cuando oyà ³ estas palabras, Paula se entusiasmà ³. (When she heard these words, Paula got excited.) exasperarse (to lose patience): (En ocasiones me exaspero. Sometimes I lose my patience.) preocuparse (to become worried): Nos preocupamos por el nivel acadà ©mico de los alumnos. (We got worried about the academic level of the students.) sorprenderse (to become surprised): Me sorprendà ­ cuando veà ­a que era tan joven. (I became surprised when I saw she was so young.) Using Ponerse and Volverse The reflexive verbs ponerse and volverse are frequently used to refer to changes in emotional state. Although the two can be interchangeable, the difference is that ponerse tends to be used for rapid changes in emotions while volverse tends to be used for more lasting changes. El jugador se puso triste por no ser titular. (The player got sad for not being the champion.) Mi problema es cuando mi amigo se pone indiferente conmigo. Latent Defect Essays Latent Defect Paper Latent Defect Paper Mike Christensen December 10, 2009 CM 385: Section 1 Final Paper How Can A Contractor Avoid Liability for Defective Work? Every contract created produces a margin of risk and a platform for success. Depending on how one manages the risk assumed, one may either excel and shine in the glory of success or drown and disappear in the raging waters of error. Nevertheless, to become great one must take that step of faith into the flailing wind. As said by Leo F. Buscalglia, â€Å"The person who risks nothing – does nothing, has nothing, is nothing, and becomes nothing. He may avoid suffering and sorrow, but he simply cannot learn†¦ and grow†¦ and live. † (Buscalglia, 2009) The contractor who is bound to the owner must understand the risk assumed regarding defective work. This understanding will create a critical eye for the contractor that will help mitigate risk. To begin, the contractor must recognize what a defect is and the different categories that a defect may be classified as; the various categories will provide opportunities for the contractor to have future claims barred after acceptance. The two main classifications for defective work are known as: patent defects and latent defects. According to the Steven H. Gifis, the author of Law Dictionary, a patent defect is a â€Å"defect that could be recognized upon reasonably careful inspection or through the use of ordinary diligence and care. † To assist in avoiding claims against the contractor due to patent defects, a contractor will create a punch-list, which list will include specific items that need to be checked; and if needed, corrected, prior to the sale of the project. Usually the contractor will walk through the project with the owner to identify any corrections needed. Upon acceptance of the work by the owner, which can be manifest by payment or taking possession of the project (i. e. substantial completion), any future patent defect claims cannot be brought against the contractor. The defect should have been recognized upon a reasonably careful inspection, completed by filling out the punch list. A prime example where a contractor and owner are protected by a future claim of defective work is found in the case, Inman v. Binghamton Housing Authority. It was six years after the completion of the Saratoga Terrace apartment complex when a child ell off the back porch stoop and received severe injuries. The parents of the child claimed that the contractor and owner were responsible due to their negligence in constructing the stoop without a protective railing. The court referenced back to the Campo v. Schofield case, which states, â€Å"We have not yet reached the state where a manufacturer is under the duty of making a machine accident proof or foolp roof. † The court also noted that the complex had been used without accident for six years and that it did not conceal any dangers or defective work that would not have been found by a reasonable inspection. The outcome of the case proved that the pleading did not contain any allegation of a defect, and that the liability rested upon the parents of the child. Consequently, the phrase Caveat Emptor (Buyer Beware) protects the contractor from future claims as long as the defective work existed at the time of inspection and could have reasonably been identified. Nevertheless, a contractor must also understand that if the defective work is classified as a latent defect, the risk and liability associated with this defect may be transferred back to the contractor. Therefore, a contractor must understand what a latent defect is and how risk might be lessened. The Law Dictionary defines a latent defect as a â€Å"flaw that is discovered after delivery; usually, latent defects are inherent weaknesses which normally are not detected by examination or routine tests, but which are present at the time of manufacture or are aggravated by use. † (2003) Consequently, this flaw may not be found until the structure or member fails, which rapidly increases the liability of the project. The most identifiers for these failures are unsatisfactory material, workmanship, or design; all of these produce results that do not comply with the contract requirements. In reference to the three common identifiers mentioned above, the most difficult to resolve is the case where the material is defective – who is responsible – the owner, architect, manufacturer, or contractor? The variety of materials is so vast and the testing so limited, that the various personnel mentioned above try to cut costs without assuming the liability. In the case, Wood-Hopkins Contracting Co. v. Masonry Contractors Inc. , Masonry Contractors Inc. ontracted to install and clean the masonry for an apartment complex in Atlanta, Georgia. Upon substantial completion, water was found leaking into the apartment due to the recently constructed masonry wall. Wood-Hopkins immediately accused Masonry Contractors Inc. for the defective work and requested that they waterproof the entire structure (a c ost of $12,255. 00). Masonry Contractors Inc. recognized that the leak came from the wall constructed by their crew, but affirmed that the contract had specifically called out the means and method of installation and material to be used, and that the material was defective, not their work. In the end, the material was found to be defective, which defect caused a failure in the bond. Thus, if the contractor follows the specifications of the owner, which specifications are found in the contract documents, the contractor is able to transfer the liability back to the owner and proceed with minimal risk. In regards to minimizing the risk associated with latent defects, a contractor should obtain the greatest amount of training to increase his workmanship, and then follow the specifications of the contract. If any questions arise during construction, he should consult the owner and designer so that liability and risk will be transferred. . In the case, Southwest Welding v. The United States, the contractor, Southwest Welding, contracted with the government to build several sections of penstock. Upon completion of each section, the government’s Contracting Officer would approve the section and installation of the section would commence and final payment would be made. The contract clearly stated that welds would be radiographically examined and that the Contracting Officer was the only person authorized to accept the work. After installing 15 sections of penstock, the Contracting Officer requested a different test be performed on the welds, which test required that the contractor remove and replace 348,000 inches of welding, equaling an additional cost of $543,343. 76. The Contractor sent letters of clarification, stating that the work previously performed met the contracted requirements and that the work requested would be additional work and would require extra compensation. After traveling the courts, the appellate court sided with the contractor due to the communication which clearly identified the requested work as extra work, because the contractor met the requirements of the contract. In conclusion, a contractor has the opportunity to take the precautions and steps necessary to bar future patent defect claims by creating a punch-list and walking through the project with the owner. The owner’s power of acceptance enforces the contractual phrase Caveat Emptor. Nevertheless, if the defects are considered to be a latent efect, the owner can still trace liability back to the owner. Because of this, the contractor must provide excellent workmanship and follow the specific language of the contract documents. By so doing, the responsibility and liability of the project flows back to the owner who initially took the risk to live, to learn, and invest in his project. Buscalglia, Leo f. (2009). Women in labour suffer from substantial fluid loss; so they need to be kept well hydrated to ensure enough circulating volumes to enable them to cope with any excessive blood loss (Hofmeyr and Mohlala 2001, p. 646). After childbirth there is the risk of haemorrhage that can come from a variety of locations. Immediate haemorrhage is more commonly associated with mortality and can come from different factors surrounding the birth. In as much as 90% of t he cases of immediate post-birth haemorrhage the cause is uterine atony which has a number of causes, including incomplete delivery of the placenta. When there are cotyledons, or retained placental fragments, there is both the risk of immediate haemorrhage and of delayed haemorrhage (Varney, Kriebs, & Gegor 2004, p. 925). The amount of bleeding can be any amount that compromises the health of the mother but is generally considered to be 500mls or more. In healthy pregnancy, women have a plasma volume increase of at least 1250mls and the red cell mass also increases, as a result women are able to tolerate up to a litre of blood loss with no adverse effects (Hofmeyr, 2001) In cases of women who suffer from severe anaemia, they may be unable to tolerate blood loss that healthy women can (Crafter, 2011). The speed of the blood flow through the intervillous space can be estimated to be about 600ml per minute (Hofmeyr et al, 2008). Napoleon Populist Autocrat Administrative Structure INTRODUCTION Napoleon Bonaparte was born in town of Ajaccio in Corsica, an island off the southern coast of France on 15th August 1769  [1]  and by then Corsica was formally under French rule. History not only remembers him as a brilliant military strategist and commander but also as ingenious and able statesman, masterful administrator and lawgiver. Napoleon graduated from Ecole Militaire in Paris in 1785 and was posted in Valence in Southern France after seven years of study in France. He came to prominence after his participation in the Siege of Toulon by forcing the British navy to evacuate the port in 1793 and after defending the National Convention from the Parisian mob he wass promoted to Rank of Commander of Army of Interior and later he on successfully led French Armies against Austrian in First Italian Campaign. After successful Italian [1796] and enchanting Egyptian [1798] Campaign; his popularity, support of military and lack of political affiliations brought him to foreground of politics and he is appointed as First Consul of France following coup of 18th-19th Brumaire on 9th-10th December 1799  [2]  . No sooner he takes the reins of France, he begins initiating reforms in various fields covering politics, civil matters, legal problems and economic situation. Instead of taking side of any political ideology or any faction, he chose a middle course by enlisting members of all the factions without considering their political affiliations but taking account of their ability and talent. This became apparent when he chose members of Council of State, Legion of Honor, Prefects, ministers and various posts in military hierarchy. This policy became the cornerstone for all appointments in France under his rule. By affecting Peace of Amiens [1802] he brought brief period of peace when France was not at war with any state. It was during this time he brought about most of his reforms, changes, creations, enlargement and growth of different institutions of France. He brought an end to political upheaval of France by silencing the different factions and later on amalgamating them into his administration. The political system envisaged made him an all-powerful and brought about centralization of political machinery. He had embarked on the civil reforms that were to make him justly famous: the pacification of La Vendee, a successful fiscal reform, a better administrative framework, overhauling of educational system, successfully conclusion of Concordat with Pope and codification of laws of France  [3]  . War again broke out in 1803, first with Britain and later other continental powers joining in the foray. Britain, Austria and Russia forming the Third Coalition threatened France, whereas Napoleon leading a coalition of Central German States inflicted crushing defeats on Austria first at Ulm [20th October 1805]  [4]  followed by the crowning victory over Austro-Russian combine at Austerlitz [2nd December 1805]  [5]  . This was followed by subsequent peace with Austrians at Pressburg and Russia at Tilsit. Prussia citing the reason of violation of neutrality of Ansbach by marching French armies declared war on France subsequently but was quickly and completely crushed in Battles of Jena and Auerstadt [1806]. On 16th July 1806  [6]  , Confederation of Rhine was established in place of Holy Roman Empire. In 1802, national vote was taken for the Life Consulate of Napoleon, the result being 3,568,000 in favour to 8,374 against  [7]  . Two years later Napoleon completed his journey to autocracy: on 3rd May 1804  [8]  Tribunate expressed the wish that Bonaparte be proclaimed hereditary Emperor of the French. The Senate and the Legislative body drew up a bill which then became an organic senates consultum. It was then submitted to the people for ratification: 3,572,000 voted yes to 2,569 nos  [9]  . Napoleon ascended the throne of France with the title of Napoleon I, Emperor of the French  [10]  . On 2nd December 1804  [11]  , he was crowned in Notre Dame Cathedral in presence of Pope Pius VII. On 17th March 1805  [12]  , he was crowned King of Italy. Subsequently, in France, a strict system of censorship was imposed and espionage system was strengthened. Whereas other parts of Empire, namely Italy, Central Germany and Holland were subjected to heavy taxes and the French reforms were imposed in these states which slowly culminated in rise of nationalism and detestation of foreign rule. Freedom of Religion was ushered during this period, first by signing of Concordat with Pope [1801] which healed the breach with the Catholic Church, then by granting equal status to Protestants as well as the Jews. Legal System was overhauled, by codifying the laws of France which dealt with matters ranging from civil to criminal laws as well as commercial law. This was a skillful blend of different laws present in France before beginning of French Revolution and the ideas of Revolution, where under the leadership of Napoleon  [13]  , utmost importance was given to simplicity, lucidity and pragmatism. Four of the finest jurists of France of the date representing Northern Customary laws along with Southern Roman influenced laws worked to produce a codification of laws which has stood the test of time and is still is a law of France. The end of war against Britain nowhere in sight, Napoleon Bonaparte declared Continental Blockade against Britain which would result in complete end of trade with Europe. The Blockade will achieve its peak by 1811, when entire Europe accepted the Continental Blockade. To enforce Continental Blockade, he conquered Naples, Portugal and later Spain. Portugal and Spain involved France in long drawn out protracted Peninsular War which would continue till restoration of Bourbon Monarchy in 1815. When France was involved in Peninsular War, Austria forming an alliance with Britain declared war on France with hope of breaking hegemony of France in Europe. Napoleon smashed the Austrians and within a month occupied Vienna. It will not be until 1812 invasion of Russia that France supremacy will be disputed and at finally Napoleon will be defeated in Battle of Waterloo and later exiled to St. Helena. It was during this period, when Napoleon brought in administrative, civil and legal reforms most of which still survive in France as living testimony to the magnificence of work done during this period for France. Napoleon followed, Everything for the French People  [14]  as his motto, and this is reflected in his brilliant conquests and practical, down to earth but still long lasting reforms which he brought in France and subsequently in the conquered territories. In long run, most of these reforms will form the bedrock of French political, legal and administrative structure which at that crucial moment of French history provided France with stable, efficient and progressive government. French people hailed all of these reforms, and most of them are still part and parcel of French administration in modified forms. LIBERAL AUTHORITARIAN ADMINISTRATION: POLITICAL COMPROMISE, FLEXIBILITY AND NATIONAL STABILITY The centralized administrative system which has prevailed in France was the handiwork of Napoleon  [15]  . Napoleon knew and very well understood the exhaustion and antipathy of people after a chaotic Revolution and an oppressive ancien regime. People tired and disgusted with bloodshed, constant change of governments, coups, political instability, extremities and constant danger of counter-revolution by royalist were longing for a stronger, efficient and stable government which would prevent decay of the system and preserve the ideals of revolution. The French during the Revolution had attacked the despotism of kings, the political inequality of many constitutions only partly free; the pride of the nobility; the domination, intolerance, and wealth of the priesthood, and the abuses of the feudal system, all of which were still rampant in most of Europe  [16]  . Napoleon understood the philosophy behind these ideals and hence went on to realize the goals and preserve the ideals of Revolution but only after ensuring political stability of France and safeguarding it from counter-revolution and internal strife. After a successfully taking over the administration of the France, he understood the situation of people and different factions. And rising above the factions and making merit as the spirit and substance of his rule he decided to usher an era of political stability, administrative efficiency and economic improvement. We have done with the romance of the Revolution: we must now commence its history. We must have eyes only for what is real and practicable in the application of principles, and not for the speculative and hypothetical. Napoleon, at Conseil detat  [17]   Above statement gives clear picture of frame of mind of Napoleon and the people presiding with him. They understanding the sentiments of the people as well as need of hour and under the guidance of Napoleon himself went on to reorganize the government and administration. POLITICAL SYSTEM: The centralized government was divided into Consulate, Senate, Corps Legislatif and Tribunate. Title IV of the Constitution of Year VII  [18]  gave plenty of powers to Napoleon who was to be First Consul. Art 41  [19]  of Constitution gave him the power to promulgates laws, appoint and dismiss at will the members of the Council of State, the ministers, the ambassadors and other foreign agents of high rank, the officers of the army and navy, the members of the local administrations, and the commissioners of the government before the tribunals. Art. 52  [20]  gave Napoleon the power to direct the council of state which was charged with drawing up projects of law and regulations of public administration and deal with difficulties which arise in administrative matters. Executive power was vested in three consuls, but, as first consul, it was effectively in Napoleons hands, the other two acting as advisers. Yet they had to work to a legislature. It rested on a very complex form of indirect election. Each commune voted a list of persons, numbering one-tenth of its citizens, deemed worthy to conduct public business. This list then proceeded to elect one-tenth of its number and these made up the departmental list. This in its turn elected a tenth of its members this was the national list. The choice of members was vested in a new body, the Senate. From this list first the Consulate appointed twenty-four members and these co-opted others to form a body of sixty. These sixty then drew up a list of 100 members for the Tribunate and 300 for the Legislature. The Tribunate could discuss or propose legislation but not vote on it whereas the Legislature could vote but not discuss it, and neither Chamber had a legislative initiative. That came from the executi ve, i.e., from Napoleon working with his Council of State. The power delivered to the executive was therefore immense, but it should not be supposed that the members of these bodies were nobodies.  [21]   A senatus consultum of August 1st forthwith proclaimed Napoleon Bonaparte Consul for Life  [22]  , which was then put to the people in a plebiscite. The official figures were 3,011,007 in favour and only 1,562 against  [23]  . Napoleon now gained few and additional powers, he had the power to nominate the other two consuls, could appoint his successor. The three legislative bodies lost practically all their powers, those of the Corps Legislatif going to the Senate, those of the Council of State to an official Cabal formed out of it; while the Tribunate was forced to debate secretly in five sections, where, as Bonaparte observed, they might jabber as they liked.  [24]   The victory of action over talk, of the executive over the legislature, of the one supremely able man over the discordant and helpless many, was now complete.  [25]  With the establishment of Empire, Napoleon became all powerful with other bodies now losing all the powers. But as a prudent and cautious statesman, he referred all his acts to people as plebiscite. In his own words, The appeal to the people has the double advantage of legalizing the prolongation of my power and of purifying the origin. In any other way it must always have appeared equivocal.  [26]  It was then submitted to the people for ratification: 3,572,000 voted yes to 2,569 nos. The Corps Legislatif disappeared and the Tribunate is not heard of after 1808. The Emperor was sole ruler.  [27]  The Senate was brought firmly under the Emperors control and thereby ceased to exist as an independent body.  [28]  The Senate had the appearance but not the reality of great power.  [29]   By now France came under extremely centralized rule, which ensured till 1815 France safety from civil strife, revolt and any form of dissension from any of the factions present in France at that time. Also, Napoleon took only those into political posts who possessed talent and merited the post irrespective of their political affiliations. This and other measures taken by him to bring Democrats, Republicans, Jacobins and later Royalists succeeded to bring them into his fold. Also creation of Legion of Honor created a class of loyalists who stood by him till the end. Centralization of Power and creating a class of loyalists brought political stability to France at turn of century when political ideologies clashed throughout Europe. ADMINISTRATIVE SYSTEM: Entire Republic was divided into departments and arrondissements with each department having a Prefect, Council of Prefecture and Department General Council with Prefect enjoying absolute powers and privileges in the department while conducting day to day affairs  [30]  . Napoleon while reorganizing administration completely eliminated elective system and appointing  [31]  Prefects to conduct the affairs of the Department, while sub-prefects were placed over the new arrondissements and mayors over the communes. The mayors were directly appointed by the First Consul in communes with population of over 5,000 whereas Prefects appointed the mayors for remaining communes. The administrative machinery aided in maintaining control over different areas of the Empire, along with providing administration which was lacking for a long period of time in France. Indeed, so little was there of effective self-government that France seems to have sighed with relief when order was imposed by Bonaparte in the person of a Prefect.  [32]  The Prefect was primarily the political agent of the Government.  [33]  Vigorous censorship which was imposed in whole of France along with a complex but effective network of spies under the charge of Fouche prevented political opponents a ground to protest whereby maintaining political stability. The country was honeycombed with spies and informers and watched over by a vigilant and efficient police.  [34]   Napoleon working with Cambaceres brought about the authoritarian structure in place and later in the days of Empire it was Cambaceres who worked meticulously while dealing with administrative matters. Napoleon took up the tasks of regular tax payments, law and order, education, military supply, regulation of grain trade, censorship and host of public projects which included tasks of various types from beautification of Paris with which Napoleon attached prime importance to construction of roads to connect all the cities of France with Paris and later their enlargement and maintenance. All of this was done and achieved and efficiency was insured by maintaining a network of spies, enactment of strict penal code [1810] and Napoleon always giving precedence to merit over all other considerations while making appointments. The administrative structure which though has undergone many changes but has still survived in its essence till date in France. AUTHORITARIANISM IN DAILY LIFE: EDUCATION AND RELIGION Napoleon embarked on the civil reforms that were to make him justly famous, which all had authoritarian structure in place so as to allow Napoleon to adjust them to his wishes. This is very well observed in relation to his Education Policy and Religious Policy. Law of II Floreal  [35]  which dealt with Education Policy to followed in France was passed on 1st May 1802, whereas Concordat and subsequent organic legislations which dealt with religious question were made in first years of his rule, which though provided general people with education and religious freedom hitherto unknown but gave Napoleon a supreme position over them and manipulate them to his gain. His prime aim while enacting Law of II Floreal was to bring education to common public and use it as a propaganda to improve his image and maintain control over France. Breach with religion and later persecution of religion during Revolutionary years had brought much unease throughout France, especially rural populace who were still devout, hence he decided not only to allow religion and tolerate different faiths in France but also to heal the breach with Papacy. This was achieved through Concordat and organic legislations passed by him over course of his reign. EDUCATION IN FRANCE: I want a teaching body, because such a body never dies, but transmits its organization and spirit. I want a body whose teaching is far above the fads of the moment, goes straight on even when the government is asleep, and whose administration and statutes become so national that one can never lightly resolve to meddle with them. Napoleon  [36]   Educational System in France went under complete change. Schools run by Church which were prime source of education during ancien regime and which were closed down during Revolution were not substituted by an equal structure which led to abysmal situation of education in France. Napoleon desiring to bring an end to the abysmal situation and using it as a tool to achieve his end of making the future generations of France loyal to the state and him brought about an overhaul. The new educational policy aimed at creating a new loyal group of people and to fashion them as able breadwinners, obedient citizens and enthusiastic soldiers  [37]  . Elementary schools were left to the control and supervision of the communes and of the sub-prefects  [38]  . The law of II Floreal, however, aimed at improving the secondary education  [39]  , which the Convention had attempted to give in its ecoles centrales. These were now reconstituted either as ecoles secondaires or as lycees. The former were local or even private institutions intended for the most promising pupils of the commune or group of communes; while the lycà ©es, far fewer in number, were controlled directly by the Government. In both of these schools great prominence was given to the exact and applied sciences. The training was of an almost military type, the pupils being regularly drilled, while the lessons began and ended with the roll of drums. The numbers of the lycees and of their pupils rapidly increased; but the progress of the secondary and primary schools, which could boast no such attractions, was very slow. In 1806 only 25,000 children were attending the public primary schools.  [40]   But two years later elementary and advanced instruction received a notable impetus from the establishment of the University of France  [41]  . The new University of France was admirably suited to his purpose. It was not a local university: it was the sum total of all the public [pg.297] teaching bodies of the French Empire, arranged and drilled in one vast instructional array. Elementary schools, secondary schools, lycees, as well as the more advanced colleges, all were absorbed in and controlled by this great teaching corporation, which was to inculcate the precepts of the Catholic religion, fidelity to the Emperor and to his Government  [42]  , as guarantees for the welfare of the people and the unity of France. For educational purposes, France was now divided into seventeen Academies  [43]  , which formed the local centres of the new institution. Thus, from Paris and sixteen provincial Academies, instruction was strictly organized and controlled; and within a short tim e of its institution (March, 1808), instruction of all kinds, including that of the elementary schools, showed some advance. In realm of exact and applied sciences, splendid discoveries were made and it prospered. But literature and poetry took a back seat primarily because of lack of support and secondly because of rigorous censorship. In the end it served the purpose of Emperor, created a class of loyalists and exact and applied science made a long strides and France was to remain the hub of scientific studies for another half a century. CONTROL OVER RELIGION: Napoleon in order to decrease the uneasiness among the population took steps to reconcile Papacy, Protestants and even Jews later. He intended to use religion to gain support of the people as well as wield and attach them to his rule. On 15th July 1801, he signed Concordat with Pope in which French Government recognized that the Catholic apostolic and Roman religion was the religion of the great majority of the French people. It was to be freely and publicly practiced in France, subject to the police regulations that the Government judged necessary for the public tranquility. A new division of archbishoprics and bishoprics was now made, which gave in all sixty sees to France. Napoleon enjoyed the right of nomination to them, whereupon the Pope bestowed the canonical investiture. The archbishops and bishops were all to take an oath of fidelity to the constitution. The bishops nominated the lower clerics provided that they were acceptable to the Government: all alike bound themselves to watch over governmental interests. The stability of France was further assured by a clause granting complete and permanent security to the holders of the confiscated Church lands a healing and salutary compromise which restored peac e to every village and soothed the qualms of many a troubled conscience. On its side, the State undertook to furnish suitable stipends to the clergy.  [44]   Napoleon made several laws under the plea of legislating for the police of public worship. The organic articles forbade the application of Papal bulls, or of the decree of foreign synods, to France, they further forbade the French bishops to assemble in council or synod without the permission of the Government; and this was also required for a bishop to leave his diocese, even if he were summoned to Rome. The regulation of the Protestant cult in France was a far less arduous task, Napoleon recognized two chief Protestant bodies in France, Calvinists and Lutherans, allowing them to choose their own pastors and to regulate their affairs in consistories. The pastors were to be salaried by the State, but in return the Government not only reserved its approval of every appointment, but required the Protestant bodies to have no relations whatever with any foreign Power or authority.  [45]   In the years 1806-08 the position of Jews was likewise defined, at least for all those who recognized France as their country, performed all civic duties, and recognized all the laws of the State. In consideration of their paying full taxes and performing military service, they received official protection and their rabbis governmental support.  [46]   Napoleon succeeded to bring the different religious institutions under government control and even controlling and regulating their affairs, so as to prevent them from rising up against the government and at the same time making people content. REFORM OF JUDICIAL SYSTEM I will go down to history with the Code in my hand. Napoleon  [47]   Law for Reorganization of Judicial System  [48]  was passed on 18th March 1800 making judiciary a simple hierarchy of courts. At lowermost level, i.e., for every commune there was a Tribunal of First Instance which was presided over by Justice of Peace which dealt with civil as well as correctional police matters.  [49]  Every department had a Criminal Tribunal which had jurisdiction over all the criminal and correctional police matters in the department.  [50]  Twenty-nine Tribunals of appeal were established throughout France to hear civil and commercial matter from Tribunal of First Instance.  [51]  Tribunal of Cassation sat in Paris which was the final court where appeal could be made from Criminal Tribunal or Tribunal of Appeal which was composed of forty-eight judges.  [52]   A single code for France was the dream of King Louis XI in the fifteenth century, of Dumoulin (1500-66) and Brisson in the sixteenth, of Colbert and Lamoignin in the seventeenth, and of DAguesseau in the eighteenth. The four last named made substantial contributions toward such a project Brisson, by his compilation of the ordinances in force under Henry III, Colbert and Lamoignon, through a more celebrated ordinances bearing the name of Louis XIV, and DAguesseau, whose ordinances on wills, gifts, and entails appeared between 1731 and 1747, and were through codifications.  [53]  Before the outbreak of Revolution, Voltaire had tersely commented on law and order situation of France, stating Man did not often change his horse, as many as he changed law while travelling through France, which correctly gave the picture of law and order situation before Revolution. The parlements, being upholders of local customary laws proved another obstacle towards codification of law. During the Re volution, revolutionaries made many attempts to codify the laws to bring uniformity throughout France, but failed and when Napoleon took power, banditry was on rise and law and order situation had deteriorated.
